Practical Problem Solvers - Sound Advice for Environmental Law & Litigation

The environmental attorneys at Morris Downing & Sherred, LLP have diverse, broad-based experience capable of supporting our clients' litigation, regulatory and transactional needs.

Our attorneys have been involved in all phases of administrative disputes and litigation under CERCLA, the federal Superfund law, and New Jersey's Spill Act. We have represented major corporations as trial and appellate counsel in litigation involving liability for hazardous waste remediation under these statutes.

We also have strong regulatory experience before administrative boards and agencies. We handle administrative hearings on wetlands, stream encroachment, hazardous waste, and wastewater matters, as well as on issues involving a variety of permitting questions.

We regularly advise and assist our clients with Industrial Site Recovery Act (ISRA) issues, which is often implicated in commercial transactions. Our attorneys have also guided clients through the maze of new requirements under the Site Remediation & Reform Act (SRRA), including selecting a Licensed Site Remediation Professional (LSRP), and the issuance of a Response Action Outcome (RAO), which has taken the place of No Further Action letters. The attorneys at Morris, Downing & Sherred understand the constantly changing statutory and regulatory framework applicable to environmental matters and have the experience and skills necessary to advocate for your success. We have also assisted clients undertaking site investigations and remediations in New York and Pennsylvania.

Our environmental attorneys also provide support for a wide array of commercial transactions, including the environmental implications of stock transfers, asset sales and purchases, mergers and acquisitions, and drafting environmental provisions in contracts and lease agreements. Our skilled lawyers have coordinated many Phase I and Phase II site investigations, and for our Bank clients, have assessed the potential for lender liability when property is obtained involuntarily through foreclosure.

Experience. Dedication. Results.
